Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, software, signals, dashboards, and related services (collectively, the "Service") provided by Telonics Trading LLC ("Telonics," "we," "us," or "our"). By accessing or using the Service, or by clicking to accept, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Telonics Is, and Is Not

Telonics provides automated trading software and trade signals that you may connect, at your own election, to your own brokerage or proprietary-trading ("prop") account through a third-party automation provider (such as TradersPost). You retain full control of and responsibility for your own account, funds, broker, and risk settings.

Telonics is not a registered Commodity Trading Advisor (CTA), Commodity Pool Operator (CPO), Introducing Broker, broker-dealer, futures commission merchant, or registered investment adviser. Telonics does not manage accounts, exercise discretionary trading authority over your account, hold custody of your funds, or hold your broker login credentials. 2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract. The Service is not directed to, and may not be used by, any person in any jurisdiction where such use would be contrary to law or regulation. Your use of the Service is void where prohibited. Futures trading is not available or suitable in all jurisdictions; it is your responsibility to ensure your use is lawful where you are located.

3. No Investment Advice; You Make Your Own Decisions

All content, statistics, signals, and outputs are provided for informational purposes only and are not a recommendation, solicitation, or offer to buy or sell any security, futures contract, or other instrument, and are not tailored to your individual circumstances. You are solely responsible for evaluating whether the Service is appropriate for you, and you should consult your own licensed financial, legal, and tax advisors before trading.

4. Trading Risk; No Guarantee of Performance

Trading futures involves substantial risk of loss and is not suitable for all investors. You can lose some or all of your capital. We do not guarantee any profit, and many traders lose money. Performance figures presented on our website are hypothetical / backtested results and have inherent limitations; they do not represent actual trading and are not a promise of future results. Your individual results will differ based on your own risk settings, account size, broker, fills, slippage, latency, and which signals you act on. 5. Your Responsibilities

  • You configure and control your own broker/prop connection, contract sizing, and risk-per-trade settings.
  • You are responsible for monitoring your account, your broker's behavior, and compliance with your broker's and any prop firm's rules.
  • You are responsible for all activity under your account and for keeping your credentials secure.
  • You are responsible for all taxes arising from your trading.

6. Third-Party Services

The Service relies on third-party platforms you choose to use, including order-automation providers (e.g., TradersPost), brokers, prop firms, and data and payment providers. We do not control and are not responsible for those third parties, including their execution, fills, slippage, outages, downtime, errors, or changes. Your use of those services is governed by their own terms. We do not store your broker login credentials.

7. Fees, Billing, and Cancellation

Access to the Service is provided on a subscription basis at the fees disclosed at the time of purchase. Fees are billed in advance and are non-refundable; you may cancel at any time and will not be billed for subsequent periods. See our Refund & Cancellation Policy.

8. Intellectual Property & License

The Service, including its software, algorithms, signals, content, and trademarks, is owned by Telonics and protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own personal trading. You may not copy, resell, redistribute, sublicense, reverse-engineer, or share the signals or software, or use them to operate a competing service.

9. Acceptable Use

You agree not to misuse the Service, including by attempting to disrupt or gain unauthorized access to it, scraping it, or using it for any unlawful purpose or in violation of any exchange, broker, or regulatory rule.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that signals will be delivered, executed, timely, or profitable.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELONICS AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Telonics and its owners and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your trading, or your violation of these Terms or any law.

13. Dispute Resolution; Binding Arbitration; Class-Action Waiver

Any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration, administered by the American Arbitration Association (AAA) under its applicable rules, seated in Arizona. You and Telonics waive any right to a jury trial and to participate in a class, collective, or representative action.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date, and your continued use of the Service constitutes acceptance.

16. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your license ends; sections that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification, dispute resolution) will survive.
